E-signature for real estate agents and brokers

docuinked lets a brokerage send listing agreements, buyer representation forms and disclosure acknowledgements from its own systems, with an agent preparing the draft and a named person approving it before any client sees it.

What a brokerage signs

Most of the paper in a sale is routine, but it moves fast and it goes to people who are not in your office. A typical brokerage sends:

  • Listing agreements with sellers.
  • Buyer representation agreements.
  • Disclosure acknowledgements, where the client confirms they received a form.
  • Showing and open house waivers, which work like a liability waiver.
  • Referral agreements between agents, often a short letter of intent or fee split.
  • Independent agent agreements, which look a lot like an independent contractor agreement.
  • Vendor contracts with photographers, stagers and cleaners, plus a photography release for listing photos.

Your state association often publishes the forms themselves. docuinked doesn't supply them. You upload the PDF your broker uses, place fields once, and save it as a template.

A workflow story

A small residential brokerage with eight agents keeps its leads in a spreadsheet-based CRM. Here is how a listing appointment turns into a signed agreement.

  1. The agent marks the lead "listing appointment booked".
  2. A Make scenario fills the brokerage's listing agreement PDF with the address, list price and commission from the row.
  3. It calls create_document with the seller as signer 1 and the managing broker as signer 2, with ordered set to true so the seller signs first.
  4. The managing broker gets an approval request, opens the draft, and checks the price and the commission against the row.
  5. The broker approves. The seller gets an email and signs on a phone at the kitchen table.
  6. The broker countersigns. The document.completed webhook moves the row to "Active listing" and saves the sealed PDF to the deal folder.

The approval step is the point. A wrong commission figure sent to a seller is hard to walk back. Read more on signing order.

An agent example

An agent in Claude or Cursor connected by MCP can do the dull part. You might say: "Prepare the buyer representation agreement for the couple I met today, using the template, and send it." The agent calls create_from_template, then send_document. Over MCP that call can't send. It returns an approval_url, and you read the draft as the server holds it before it goes. See approvals and human-in-the-loop.

For a fixed flow without an agent, one HTTP step works from any automation tool:

curl https://docuinked.com/v1/documents \
  -H "Authorization: Bearer $DOCUINKED_API_KEY" \
  -H "Idempotency-Key: listing-4471" \
  -H "Content-Type: application/json" \
  -d '{"title": "Listing agreement, 12 Elm St",
       "pdf_url": "https://example.com/listing-4471.pdf",
"signers": [{"name": "Sam Ortiz", "email": "sam@example.com"},
                   {"name": "Managing Broker", "email": "broker@example.com"}],
       "ordered": true, "send": true}'

The Idempotency-Key means a rerun of the same row can't send a second agreement. See idempotency.

For real estate software

If you build a transaction or CRM product for agents, you can put signing inside it under your own name. Each brokerage becomes a sub-account under one API key. Signer pages and emails show your name, logo and accent colour, and docuinked branding can be removed. Signing can be embedded in an iframe on the sites you allow, with browser events telling your page when the client is done. Signing emails still come from docuinked's address for now, because custom sending domains are coming. See platforms and white-label.

What docuinked doesn't do here

  • Deeds and recorded documents. Deeds that must be recorded follow county and state rules. Treat them as out of scope.
  • Mortgage notes. Electronic notes need an authoritative copy and registry systems that docuinked does not have.
  • Default and foreclosure notices. ESIGN does not cover notices of default, foreclosure or eviction under credit or rental agreements for a primary residence. See 15 USC 7003.
  • Notarization. We don't offer it. See notarization.
  • ID checks and SMS codes. These are coming. Today a signer proves control of their email, and you can add an access code shared by phone.

Common questions

Can a seller sign a listing agreement on a phone?

Yes. The signing page works on any phone browser. The seller opens the link from their email, agrees to sign electronically, reads the whole document, and signs. No app or account is needed.

Should every listing agreement need a broker's approval?

We would say yes when the commission or price is filled in by software. A fixed form sent by your own server can use a "Sends directly" key, but a filled-in number is exactly where a mistake hides.

Can both buyers on one offer sign the same document?

Yes. List both as signers, up to 10 per document. Set ordered to false so they can sign in any order, or true if one must go first.

Does docuinked supply my state's purchase contract?

No. Use the forms your broker or association gives you. docuinked sends and seals the PDF you upload. It doesn't write or check contract text.
